Assuming that your passenger is an adult, they can make their own decision. The insurance company may reduce liability for *their* injuries (understandably so), but that is it.
The thought processes of some people are... umm... rather questionable.

If you have an unsecured person (large or small) in your vehicle, and have an accident, that person becomes a flying object. Get it? Not only can they be badly hurt, or thrown out of the vehicle, they can also collide with YOU, as in breaking your neck.

And they may push you down and catch that piece of rebar coming throught their chest rather than it going through your head. Safety isn’t a joke but these days the effort seems to prevent 100% of injuries even when their likelihood of happening is extremely low. At 69 I’ll wager anyone that the coroner does not write ‘Death by flying body’ on my death certificate.
