Got rear-ended on the freeway...

I wasn't quite sure where to put this, still a bit dazed...

@DarthVixen and I got rear-ended last night on the freeway while I was driving his Sienna minivan. We were going with the flow of traffic, which was pretty light and just gradually slowing from 60 (as we were approaching a construction zone) when we were just suddenly hit from behind and sent spinning.

Both vehicles were totaled.

We're okay, got checked out at the ER and I have a sprain in my neck and he has some bumps and bruises but for the most part just sore. The driver was up and about, checked on us right afterwards and was saying that he "looked down for just a second", and when he looked up he was on top of us.

It wasn't until our ambulance was leaving the scene that the driver noticed more smashed vehicles and dazed people walking around and called the responders over to help them, too. A 3 vehicle accident happened just after ours, in a collision I suspect was related considering we spun more than 180 degrees at high speed through 2 lanes. From what I overheard in the ER it sounded like one person was seriously injured.

The crash happened around 11:42pm last night, we finally got back from the ER around 5am and I was woken a few hours later with an unrelated medical emergency that had me in severe pain and vomiting and other goodness for a couple hours.

Now today we're trying to tackle insurance stuff and so far the insurance of the person who rear-ended us is not immediately accepting liability. This is surprising, because we were told this is a pretty cut and dried case. On scene the driver who hit us claimed he was going 40mph, but that really doesn't make sense as I know we were going 60 a few seconds prior and I hadn't braked, just took my foot off the gas.

One relief through all this to know that there's nothing I could have done to prevent it. It's also something that doesn't compute well in my brain. You can just be driving along the freeway with light traffic minding your own business and someone slams you from behind out of the blue.

I'm glad we're okay, and it now gives me the luxury of wanting answers and wanting things to get sorted out. Some family members are giving us a hard time and really don't get how serious the accident was and how lucky we are no one else hit us as we were spinning out and came to a stop facing oncoming traffic directly in its path.

So....that happened. Still trying to figure out how life comes back together after something like this.

That totally stinks, glad u guys are OK physically.
 
Bitty, don't assume the vomiting has nothing to do with the accident.  I'm hoping that the driver at fault has insurance because you may need physical therapy for your neck.  God bless!  Glad you weren't hurt more seriously.
 
He does have insurance, though thus far insurance is hesitant to accept liability for it.

First thing I did today is call my neuromusculoskeletal specialist, a doctor who does a whole lot more than just physical therapy, and asked him when's the soonest @DarthVixen and I could see him. Years ago structural issues turned out to be a significant key in improving my health to the point it's currently at, so I'm aware of how insidious a seriously debilitating injury can be. I'm confident we'll be in good hands!

As for the vomiting....I'm debating with myself whether to share a lot of massive gross details about both this incident and my medical history. I think it's probably sufficient to say that I had a similar episode the day before, and another one occurred about a month prior. It is a collection of many symptoms besides vomiting, some of which are very unique, that always occur together and present the same way and has been happening sporadically for years.

Get the police report ASAP.  

The last accident I was in was with an uninsured motorist.  I am so glad I spent the extra money on the complete bells and whistles policy.  

Trauma can be a big trigger.  Be careful out there, the other driver is crazy!    (or texting!) 

I am glad you are still able to function.

Sending you good thoughts to you both. How scary to have that happen. Hope things get worked out with insurance quickly.

Glad you both are ok. No doubt the other driver was texting. Why else would you look down? I know my dash board instruments by feel. Anyway, yes see your neuroskeletal doc. Amazing how a neck injury can cause such trouble down the road. You guys take care. And don't forget to get a copy of that police report. (((((Bitty)))))
 
bad luck, glad to hear you are both reasonably ok. I was hit once at a traffic light at 30 mph what I remember was how violent the whole thing was, very unsettling.
 
Glad your both OK!

Not that it would have prevented the accident, but when I see a mass slowing of traffic up ahead, I turn on my hazards to let people behind me know something is going on.

It wasn't anywhere near slow enough for that. It was approaching a construction site, which just meant the lanes kept changing so everyone was naturally going a bit slower than normal speeds. My guess would be just 10-15mph under the speed limit in the distance up ahead before we got hit. There was at least, I'd estimate, 30 car lengths' empty road in front of me in all lanes, and I wasn't gaining on the vehicles ahead very quickly. I was just in the process of squinting way ahead to figure out which lane would be best and whether I should slow down when we were hit.

I love hearing little tips like this, though. I've taken to using my brights when I pass a vehicle pulled over after dark, in addition to getting into the next lane if I can. It gives me a better view to feel confident I'm not hitting anyone or anything, and also more clarity on the situation whether I should call it in, in addition to hopefully alerting other drivers behind me. Some people walk awfully close to the lane lines without reflective clothing and it freaks me out if I don't see them ahead of time!

Yeah, that's one thing I'm grappling with. It's like my brain doesn't have any marker to compare such violent forces to, and keeps trying to understand it, to find some grounding to that memory and sensation.

I'm sorry you've been through something similar, that must have been awful.
 
First of all, glad you two were checked and released by medical as ok, but do follow-up with your Doc. (I know you will). Cars can be replaced.

Your the lead vehicle in a multi-car.... and you were rear-ended.  If it were me, the only folks I'd talk with would be a Law firm. You don't need any more grief in your world.

Just something to consider.

First off, its good to hear that you're OK, and no serious injuries for either of you..

but second...

accidents bring out the true inner demon in the insurance companies.

They're going to deny liability, payouts, and offer you you NOTHING for as long as humanly possible. PLAN ON IT!

They're going to drag their feet, and give you the cold shoulder for the better part of this next year. The last thing they wanna do is open up their wallets for you. They're gonna put your patience to the test.
Get ready to play the waiting game. Your phone calls will NOT be answered, and neither will your questions. Once they do start to make offers, they're gonna offer you SQUAT over what you need and want for dealing with this. The van you were driving isn't worth a nickle...(in their eyes). And they WILL try to make it sound like YOU were somehow responsible for the accident as well...unless you LAWYER UP!

Sorry to say this Hun, but I wish you all the best in dealing with these criminals.
If I ever had any advice for someone going through something similar, I'd tell them to hire a good lawyer ASAP! No matter how much it hurts financially at first...it's the only way you'll come out on top. Find the way.

I'm glad to here you were not seriously injured. totally sucks.
I'm not sure what state your in but you can have a good attorney NO MONEY out of POCKET. Just look around and talk to a few. Sure they will take a cut but that's how they earn there living. Been there done that! successfully.  

I do want to add something though about our driving skills, we need to be very aware of what is going on behind us as much as we do in front!. I'm not making any judgment on you Bitty please know that. I say this only because people behind us have a ton of things to distract them these days. So we really need to follow that old adage, "keep your head on a swivel".
I have luckily avoided several incidents that would have been me getting rear ended by keeping very aware of whats happening behind me.

Most folks don't like to ride with me because I don't talk while I'm driving much, LOL when I'm behind the wheel everything around me is my main concern.

BTW breaking my own rules I had an accident last year and I was the bad guy who rear ended a lady in front of me. Obviously I'm the guilty party to distraction but if this person ahead of me had just looked in her mirror when she decided to come to a sudden stop on a green light and gave me two feet, there wouldn't have been an accident. I've been in that position and as I said avoided the accident.
