I always ask. If someone does not want to be videoed, I always stop. Just because I have the right to be an asshat does not mean that I need to be one.
 
Unfortunately, there's more to photographer's rights than just whether or not you can take pictures of people in public.
 
I think a lot of Photographers resort to some special gadgets to avoid troubles.    Most notable telescopic lenses
to shoot up close photos from a distance.   Still it may violate other people's rights.

This one I get a kick out of.   When the photographer is looking away from you......he may really BE looking at you.   She may be hidden behind the corner of a building but you'd never see her. 90 degree angle lens.
